Correction, Penalties, and Appeals
Following the General Assembly’s adoption of new laws, and the Ohio Department of Health’s (ODH) promulgation of new hospital licensure rules, hospitals in Ohio have begun to experience the practical realities of state-level inspections and enforcement procedures. This presentation will provide an overview of the inspection and enforcement scheme, and it will explain ODH’s powers and discretion to revoke licenses, require plans of correction, and impose civil monetary penalties. The presenters will also explore the practical realities of these regulatory proceedings, discuss hospital’s rights to demand hearings on ODH’s enforcement decisions, and to appeal to court against adverse decisions following ODH hearings.
